Terms of Use

These Terms of Use (“Terms”) govern your access to and use of flixy.live and related services (the “Site”), operated by AdProfit (“we,” “us,” or “our”). By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.

1. The Site

The Site provides information, comparisons, reviews, and links related to software, services, and digital products. Content is for general information only and may become outdated. We may change, suspend, or discontinue any part of the Site at any time, with or without notice.

If the Site allows you to submit content (for example comments, feedback, or suggestions), you retain ownership of that content but grant AdProfit a worldwide, non-exclusive, royalty-free, sublicensable license to use, reproduce, modify, publish, and display it in connection with operating and promoting the Site. You represent that you have the rights necessary to grant this license and that your content does not violate any law or third-party right. We may remove submitted content at our discretion.

6. Third-party links and offers

The Site contains links to third-party websites and services that we do not own or control. Following those links places you under the third party's own terms and privacy practices. We are not responsible for the content, products, or services offered by third parties, and inclusion of a link does not imply endorsement.

7. Intellectual property

The Site's design, text, graphics, and branding (except third-party marks identified as such) are owned by AdProfit or our licensors and are protected by copyright, trademark, and other laws. You may not copy, modify, distribute, sell, or lease any part of the Site or its content except as expressly permitted in these Terms or with our prior written permission.

THE SITE AND CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT CONTENT WILL BE ACCURATE, COMPLETE, OR CURRENT.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ADPROFIT AND OUR AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SITE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SITE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SITE IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS, IF APPLICABLE.

10. Indemnity

You will defend and indemnify us against claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from your misuse of the Site, violation of these Terms, or violation of any third-party right, to the extent permitted by law.

11. Modifications to the Site

We may add, change, or remove features, content, and functionality at any time, and we may impose limits on certain features or restrict access to parts or all of the Site without liability to you.

12. Governing law and dispute resolution

These Terms are governed by the laws of the jurisdiction we designate from time to time, without regard to conflict-of-law rules, except where mandatory consumer protections apply. Any dispute arising from these Terms or the Site will be resolved in the courts located in our designated jurisdiction, unless local law requires otherwise.

13. Severability

If any provision of these Terms is held to be invalid or unenforceable, that provision will be enforced to the maximum extent permitted, and the remaining provisions will remain in full force and effect.

14. Entire agreement

These Terms, together with the documents they reference (such as our Privacy Policy and Affiliate Disclosure), constitute the entire agreement between you and AdProfit regarding the Site and supersede any prior agreements on the same subject.

15. Changes to these Terms

We may update these Terms from time to time. The revised version will be posted on this page with an updated date. Continued use after changes become effective constitutes acceptance of the revised Terms.
